All the cases I can think of that are taking on the AWBs are ‘rights’ cases in that they are trying to strike down the law. It seems to me another pathway is to try to get AWB violations conviction thrown out. Wouldn’t that be faster? Someone has to have a conviction for a mag or AWB violation. Especially if it the only charge, and the person is in prison, it seems that would make the case move faster?
What I do now is that in the reverse, the left would be getting arrested and getting the laws tossed. Of course, it is in their DA areas, so the risk is not that great.
Have there been any convictions? The AWB’s and mag bans seem to rely 99.999999999% on gun owners being Fudds or surrounded by Fudds who will rat them out just to feel good about themselves. They are either self-enforcing, or ignored by the three-S crowd.
Pretty much every AWB prosecution I’ve seen on the news has been a tacked on charge to some other, very justified charge (drug trafficking, murder, etc.), and they’re usually already felons and thus their right to possess any gun, “assault weapon” or otherwise, is already a moot point. Just about any case where they would try and overturn an AWB violation would be on some dude who isn’t going to be getting out of prison anyway due to the other shit he’s done. The left likes to turn thugs and lowlifes into messiahs, but I wouldn’t advise doing the same.
I’ve never seen a case where a law abiding citizen had one too many evil features on his rifle and got jammed up by a snitch at the range or a nosy neighbor or anything like that. I’m not saying such a thing hasn’t happened, but I can only imagine that gun rights groups would be making huge waves with that if it happened.
I assume, if anything, some thing would’ve come out of New York, California or maybe Maryland with the magazine ban. I agree that most likely they have been caught for some thing else, and I wonder even if they’ve been charged with these kind of violations, considering most of them are probably felons, and or are dead.
