Virginia: 1+ handgun/month; question

I filled out the paperwork for a revolver on the 13th and there was a delay in my approval. I was finally approved on the 16th and that is when I picked up my gun. I found another pistol I wanted and it will be here tomorrow. As I understand it, an exemption to the “one handgun per month” law pertains to CHP holders.

How, if at all, is the process different when purchasing more than one handgun per month? Is there any additional information I need to provide on the forms so the process isn’t stalled?

there is a section on the State form for the gun store employee to indicate how or why you would be exempt from the 1 gun a month rule…in this instance they would mark that you had a CHP and indicate what jurisdiction your CHP was from and its file number…

as far as changing the result, it likely will not…

the process for the background check is essentially the same…the only difference is when the information is submitted to the VSP they shop will indicate that you have a CHP that exempts you from the 1 handgun per month issue…

if you were delayed the first time, the chances of that changing is slim…

there are a number of reasons you could be delayed…

the most common

  1. Commonality of name: if your name is John Smith I can pretty much guarantee you will be delayed

  2. Security clearance…as much of an oxymoron as that sounds like, having a higher clearance will result in your delay. Basically what happens is when the VSP and NICS submit your check, if you have a high clearance level, your agency says “Hey! why you doing a background check on our boy?” and, whammy, delay, while its sorted out. I can’t tell you the number of irate FBI agents I have dealt with whose response was “but I have a clearance and I’m in the FBI!!!” when I told them they were delayed…

  3. Clerical error…I know, I know…say it isn’t so…the state make clerical errors!!! but it happens…mine is a perfect example…a few years ago I moved to NoVA from Orange, and decided to get a new permit so my address matched…my old permit was not expired…well, when my new locality submitted my permit the VSP never took off my old permit, so when I would get background checks done…bam! delayed because the VSP showed me as having 2 CHPs (actually it ended up being 3, but thats a longer story)…I ended up having to send a certified letter to the VSP to indicate which permit was the correct one…after that i went back to an instant…
