Hi, I’m getting ready to send in my form 1 to make a SBR.
I’ve done it before as an individual, but this time I am doing it as a trust. What exactly should I send in with the Form 1?
I have heard that I only need to send in the Certficate of Trust, but I have also heard that I need to send in the entire Declaration, Certificate, and Schedule A.
(obviously all copies).
I would like to hear from someone who has done it recently.
I just got another trust form 1 back yesterday. I sent in a copy of the trust and schedule A and certificate of trust. It took a little longer than it has been taking, 44 days this time door to door.
Here’s a snippet of a cover letter enclosed with my documents:

Dear NFA/ATF Examiner,
Enclosed, please find a check for $200, payable to the Department of The Justice, and two (2) copies each of the following:
ATF Form 1 – Application to Make and Register a Firearm
ATF Form 5330.20 – Certification of Compliance with 18 U.S.C. 922(g)(5)(B)
Declaration of Trust, including Notarized Certification of Grantors, and Schedules A, B, C
If you have any questions or concerns regarding this application, I can be best reached at the following:
etc…
Note, my Schedule A listed “$20 (twenty dollars) cash”, while both Schedule B and C listed “No Schedule Property”
I just submitted whatever Quicken Willmaker printed out, based upon the data entered to create a shared trust with my wife.
Some guys on one of the other boards were getting bounced for no Schedule A. I guess it depends who your examiner is or something. But the thought was that the ATF was wanting to make sure people were updating their trusts appropriately. I sent the whole thing, including the schedule A to avoid any delays.
I heard that too, Demigod. In fact, I heard it AFTER my F4 for the suppressor went out (early Dec). I kept my fingers crossed, and lo/behold it was approved.
FWIW, my original approved/stamped forms are my schedule A.
I don’t really care about all that…the only thing in the sch A is going to be NFA items.
I was merely attempting to push the limits of what was acceptable…in an attempt to make heads or tails of all the conflicting information i had read on the net.
So i wasn’t the least bit surprised when it got kicked back.
Dude, when you add to the trust and print out new schedules, the old ones are null and void. That was a waste of paper and I’m sure a waste of the examiner’s time trying to figure out if you know what you are doing or not.
A wise man once said “it’s better to be safe than sorry.” but he really meant to say “you should it’s BEST to be smart, better to be safe and sucks to be sorry.”
This was my first NFA item and therefore, did not have any NFA items held in trust, except for the $20 to ‘establish’ this joint trust with my wife, which therefore ‘requires’ a Schedule B and C for individually owned items to be held in trust. My examiner had no issues with what I submitted, and will argue that it was better to submit everything in support of the trust, to ensure prompt approval.
Maybe I don’t know what I’m doing, but I did get the stamp turned around within 5 weeks. Since this was my first NFA item, my Schedule A has been updated, and a new schedule A reflecting this will be submitted the next time I apply for another NFA item
So let me get this straight:
2 copies of form 1, Certificate of Compliance, Declaration of Trust with Notarized Certification of Grantors and Schedule A.
The Declaration of Trust with Notarized Certification of Grantors and Schedule A are xerox copies, NOT originals. Right?
The Schedule A list the items prior to this submittal, i.e. if I have $20 + suppressor already, those are the items on Schedule A. Right?
The SBR will be added AFTER I received my approval. Right?
(1) ATF form 5330.20 Certification of Compliance with USC 922g5b
(1) photocopy of the 8 page notarized Declaration of Trust
(1) photocopy of the notarized Certificate of Trust
(1) photocopy of the Schedule A which lists: “Rifle, make, model, ser. #XXX”
(1) $200 USPS money order
Sound good? I figured it was OK to list the rifle already. It doesn’t mention anything about it being a SBR. Currently it is just a rifle. I guess you might have difficulty listing a weapon or silencer you were getting on a Form 4.
You don’t need to put the rifle in the Schedule A right now unless it is owned by the trust. YOU bought the rifle yourself, with your name on the 4473. How would it be in the trust? You’d have to have Willmaker spit out the forms for transferring it in and sign them to include it.
I’m just going to assume you thought it had to be there. You CAN send in a blank schedule if you haven’t put anything in the trust yet. My first can was filled out on forms when there was nothing else in the trust. It’s still a valid trust even if it doesn’t own anything.
Yeah sorry Dave, I saw Schedules A, B and C and thought they were new iterations of one another. I’ve only seen a Schedule A. What is the B and C?
