Options with a jerk Gun Shop??

They have the right to not do the transfer. They do not have the right to hold property they do not own. If they refuse to get off their lazy asses and call the FBI back, then they have the RESPONSIBILITY to transfer the firearm to another dealer or back to Noveske. Holding the firearm for 20+ days is complete bullshit.

Correct Grant !! The story behind WHY my FFL guy didn’t transfer my gun till the 4th day was that one time he did transfer a gun and on the 5th or 6th day the NICS people called back and “Denied” the guy,it was a BIG O-SHIT moment and the FFL guy had to scramble to get ahold of the guy and get the rifle back !!! So I understand why the FFL is not transferring, but he is certainly being a dick in regards to everything else !!! :frowning: It is a looooooong process, takes at least 4 or 5 months, but your buddy can get a U-PIN Number as I stated and Grant did above and it makes life easier for sure,NO more Delays !!! There has to be some reason for the constant delays !! I had bought/sold/transfered guns for years and then one day I got delayed and then DENIED,Oh shit, now what,it was from something I had done in Collage many years ago in a land far away,LOL,it took 25 years to come back to haunt me,anyways, got it all taken care of,got a U-Pin number and all is well,I have bought multiple firearms without a hitch since then !! So,hope all work out for your buddy !!! CALL that CS Number for NICS,tell them the situation,be nice, say please and thank you alot and it all will be taken care of,Fast !!!

Tell them to ship the gun back to Noveske. Call Noveske and use another FFL.

It could also be someone else with a similar name/DOB. I know people get touchy with SSN’s but filling that out and you middle name may help. Tell the ass hole shop to call back reference the delay or release the gun!

I think it has already been established that they can (if they choose too) transfer it now. A smilar issue came up on a local board, reguarding a dealer that is generally considered “good” (palmetto state armory), they know the law but were specifically told not do transfers like this by their BATF agent. They don’t do them on a deny until a call back b/c they don’t want to ruffle feathers with their local agent. They posted name and phone number of the person (to back up their claim). There is no telling what your dealer has been told, right or wrong. In NC were have a permit system for handguns (if you don’t have a CCH) that is a leftover from the Jim Crow laws, if the situation came up here you could go to sheriff and get a $5 single purchase permit to bypass the NICS checks on a long gun purchase.

Sounds like back lash from Project Gun runner! ATF being arse holes for get caught forcing FFL to make illegal transfers!

This. I think I would have already demanded they return it to Noveske a long time ago.

Right. No one is saying that the gun belongs to them (though they do have possession of it legally). Good CS would be for them to transfer it to another local dealer or send it back to Noveske.

Had this happen to me. Guy got a delay and on the 3rd day, no call from the ATF. On the 4th day, they called me in a panic telling me that I couldn’t transfer the gun.

So for me personally, I like to wait about 4 days on a delay before I transfer the weapon.

FWIW, when I purchased my first handgun from a local gun shop, it was immediately delayed. They told me to check back tomorrow, which I did, still delayed. On this went for another 6 business days until on the the 7th, they told me since the FBI had not called back, they could release the gun to me. They thought it was because I have a very common name. I have purchased several others online since and have had them shipped to an FFL with no delay.

The original shop was one of the main ones NYC is suing about ‘straw’ purchases, so I can understand them wanting to cover their arsses, but I thought at some point if the application is not outright denied, then they could release the firearm.

I bought a stripped lower from a dealer at a gunshow and he had a similar experience. I found that out when I told him that my last couple NICS checks came back delayed. He was up front about it and I had no problem with how he did business and would happily buy from him again. Mine actually went through that day.

Well, here’s how things have ended up.

Precision Firearms in Baton Rouge was the “jerk Gun Shop”.

Mark, the owner of Gold-N-Guns Pawn Shop in Gonzales, LA. drove the 20+ miles today to Precision Firearms in Baton Rouge (AKA: the jerk Gun Shop) to pickup my buddy’s Noveske. So, this is the second trip Gold-N-Guns sponsored at $4/gallon gasoline to help my friend out.

If you remember, Precision Firearms wouldn’t accept a fax of the FFL and the copy of FFL had to be delivered by the person’s whose name is on the FFL. Hmmm…didn’t Precision Firearms fax a copy of their FFL to Noveske to get the gun in the first place…hmmm??

When Mark arrived at Precision Firearms and gave them his FFL, they turn the Noveske over to Mark…without an ID check…hmmm…that sure is some strict hardcore Store Policy, isn’t it???. Mark said it pissed him off that he had to hand deliver his FFL and those “spoonbills” didn’t ID him.

Gold-N-Guns is now in possession of the rifle and my buddy should be able to pick up his gun Tuesday from Mark, if he gets delayed again.
After witnessing all of this, it just looks like Precision Firearms is run by a bunch of wannabee-macho bullies…but that’s just my opinion.

Thanks for everyone’s ideas and suggestions. My buddy said he will pursue the U-PIN for the future purchases as a couple of you have suggested.

Thank y’all.

man that’s crazy. I’m glad the dealer i go to is a pretty straight up guy and always gets things done quickly.

All this bullshit would be avoided if you or your friend had a CWP, no?
I really can’t think of single a reason why he shouldn’t, and a gazillion why he should. This situation being one.

I mean seriously, 3 days waiting? I’m having a hard time with 1 hour. Which is usually what it takes.

That would be my suggestion. As soon as possible.

…Three days is the minimum for a delayed check. It’s the law.

Help me out here - since 've never had to wait more than an hour, what am I missing? (or not)
Is this something they can do regardless if one has a CWP?

duplicate information…sorry

man i thought california sucks when it comes to this…OP proved me wrong…but california still sucks when it comes to fire arms.

I’d give Mark at GoldnGuns a $100, a sincere thank you, and all my future FFL business if I was your friend. Glad I’ve never had those hassles…the blessings of an uncommon name and a spotless background I guess,
