That ain’t good.
But the downloading porn thing can be a scary place. I’ve seen people randomly download things purely for shock value such as chicks fucking donkeys, all manner of poop videos and other truly bizarre things that you once had to mail order because even the local adult video rental spot wouldn’t touch it with a 10 foot pole.
I can’t imagine it’s too difficult to end up looking at child porn if you are surfing for transvestite midgets fucking donkeys. And it doesn’t take much self rationalization (FOR SOME PEOPLE) to decide "hey if I can look at this, there really isn’t anything wrong with watching a 14 year old (official disclaimer: I personally have no interest in seeing any of this bizarre crap, especially anything with kids) having sex.
And to make it worse, they keep it on their computer.
Now I’m not trying to suggest this is what happened, for all I know this guy is a true sicko who gets off on watching kids have sex and really is a danger to the community. But a lot of people just don’t take this shit seriously because of how prevalent it can be and they end up with the same shocked look on their face when arrested for kiddie porn as the guy who is registered as a sex offender for taking a piss in the alley.
And that is why I get my porn the old fashion way, by DVD. I’m really not into clips and shorts and downloading an entire film hogs resources and never burns to DVD with the same quality as a studio release (even when they are from a VHS source). It’s been years since I’ve even searched videos online, scary enough when you accidentally find midget / transvestite / poop videos, I’d hate to see worse - just isn’t my thing. Even excessive tattoos can be too much for my tastes.
Additional clarification: I personally ain’t into what I call the “weird shit.” Boobs and butts have always been enough for me, it’s one area where I have pretty simple tastes.

Which honestly translates to “had them on his computer” while logged on to a file sharing system. Problem the same program where he got them in the first place.
If I go to “musicpeer.com” to download the latest crappy pop music mp3 while I am logged on people can download files from my music folder. It’s not the same as me “sending a file to another user” when he is in fact downloading it from me, but that is how they are characterizing it for sensationalist purposes.
And AGAIN, because it seems necessary, I am NOT trying to defend this guy.
It is possible he had 100 gigs of the most fucked up child porn one can imagine and was heavily engaged in file sharing those videos with other fucked up people. And IF that is the case he is a sick fuck who nobody needs around.
However, IF he was one of these idiots I see all the time who download strange and bizarre crap simply because they’ve never seen it before and now have the opportunity (same as beheading videos and shit like that) and he left it on his computer in his share file then that doesn’t make him the same individual described in scenario B.
This raises an important issue.
Say you like to go to YouTube and watch videos that predict some sort of religious apocalypse, or maybe the latest videos uploaded by the Michigan Militia or some horseshit.

I’ll have to disagree with you on the “guiltless because I didn’t pull the trigger” bit. That won’t fly in the courts. A number of students on my campus learned that with music and sharing networks.
If you connect to sites that distribute material illegally and you have a share folder that is then accessible to others, by law you are then a distributor of anything gained from your shared folder. Like it or not, that’s the way it’s viewed legally “participation in a crime”.

I realize that’s an extreme example, but that is really what you get if you carry this to the logical conclusion.
You also have to keep items in the shared folder. If I were the type of person who visited the bay of pirates I sure as heck wouldn’t keep anything I had found in a shared folder. Maybe still on the same hdd but my shared folder would either be empty or just have .pdfs of the Bible or other religious texts that are in the public domain.
