Derek Chauvin appeals for retrial

FYI. While I’m not convinced the outcome will change, there’s no doubt at all he didn’t get a fair trial in that city at that time and retrial justified. Overturning the conviction at the local level will never happen and was rejected as expected.

" In his newest fight against the judicial system, former Minneapolis police Officer Derek Chauvin is demanding the court reconsider his push for a new trial.

Court documents say Chauvin recently filed an appeal against a judge’s decision denying his petition for post-conviction relief.

Chauvin was convicted of the in April 2021."

Do you think Karmelo Anthony will have this difficulty when he seeks a new trial?

Chauvin got so screwed over because of some crack head felon. It’s frightening really.

Crack head felon and a mob of goons wielding pitchforks.

Fun fact: If you can speak (i.e. you can say “I can’t breathe”) then you can, in fact, breathe.

So how was this kid able to talk until he died from asphyxia?

It’s not even relevant to that case. The “I can’t breath” thing is really what had him removed from the squad car and placed on the ground. He was on multiple drugs, had extensive heart disease, and had a knee in his back (or neck depending on who who you believe), which likely all contributed to his death. That’s pretty much the conclusion from the autopsy.

The doc who did the autopsy stated "Dr. Baker told investigators Floyd had 11 nanograms of fentanyl per milliliter in his bloodstream and, ‘If he were found dead at home alone and no other apparent causes, this could be acceptable to call an OD. Deaths have been certified with levels of three (nanograms).’” And that’s ignoring he has a bunch other drugs in his system, and they can act in combination to be additionally lethal. Drugs, all long list of serious health issues, and the position GF was placed in and held, likely all contributed to his death. That also seems the conclusion of the autopsy if one reads it closely. Had any of them not been present, a good likelihood he’d have survived. I think the aspect that got DC in trouble was that he failed to attend to GF for an extended period once he was no longer responsive, and the logical and perhaps justified second-degree manslaughter, which covers deaths caused by culpable negligence rather than an intent to kill. Having said that, there’s no way any sane person can claim DC got a fair trial in that city at that time and on that alone, should have gotten a retrial.

If Chauvin had rolled Floyd on to his side per training they all received(which Thomas Lane brought up) there wouldn’t have been an issue.

Also, 11ng/mL is not exactly high for an addict.

I didn’t have the temperment to be a LEO, but if I am ever accused of choking a unruly crimminal junkie to death, there will be no question because I will have a death grip on his throat an you will have photos and NSFW audio.

I’m reminded of a Liquor Store Owner in Chicago who had his Alley taken over by the Professional Homeless. His Delivery Drivers got Hijacked and Robbed a Couple of times. The Store Owner as a percieved token of Peace began leaving a case of Cheap Wine out for them. On the 4th day he took half the Wine out of the Bottles and topped them off with Anti-Freeze, POOF ! No more problems in the Alley.

I feel Bad for the Guy, but if it was that Bad he should have left the City and found a job elsewhere.

Doesn’t matter; we live in a post-fact society. The truth doesn’t matter, just the narrative and feelings. The leaches of society needed a reason to Burn, Loot and Murder so the MSM and demonrats gave it to them and if it helps derail the 2020 election for the Repubes even better. Remember that summer? Going to church spread Covid but rioting elbow to elbow does not. Only f’ing idiots believed the narrative and this country is filled with idiots.

If his Attorney is correct there was some very big procedural errors that might throw the case out.

Go to 6:20 to hear the Attorney Speak.

Chauvin is looking to have his conviction vacated and the charges dismissed.

In the petition, Chauvin’s legal team is requesting a court order declaring that the assignment of authority of the case to Minnesota Attorney General Keith Ellison was “illegitimate” and a violation of his due process rights. Additionally, they’re asking for a court order declaring that the failure of the Hennepin County District Court to convene a grand jury before any charging decision and the failure of prosecutors to secure an indictment also violated Chauvin’s due process rights.

It was a textbook show-trial.

I think Keith Ellison was wanting to bury this Guy and he was angry. His anger brought all of this about.

Now he can stew in his anger.

That is a fact. I’m not even going to claim the outcome would be different had a legit trial taken place, but anyone who claims that was anything but a show trial is delusional moron.

Keith Ellison does it again and get’s his nose far out over the tips of his Ski’s.

If Minnesota Attorney General Keith Ellison (D) thought it would be easy taking Texas Gov. Greg Abbott (R) to court over an Immigration and Customs Enforcement (ICE) agent, he badly misread the room.

Ellison is trying to force Abbott to extradite ICE agent Christian Castro, who is facing charges in Minnesota stemming from a January shooting that took place during ICE’s immigration enforcement surge in Minneapolis. Ellison had set an extradition deadline of 5:00 PM last Monday – a deadline happily Abbott ignored. And he had his reasons.

Abbott’s response to Minnesota got right to the heart of the matter: “I don’t trust Tim Walz on anything, let alone something like this…” As for Ellison’s demand that Castro be turned over? “I got a demand of my own, and that is, it’s time for Minnesota to step up and repay the United States of America and Americans for all the fraud that they have committed in their state under federal programs,” the governor said.

So, of course Greg Abbott laughed in Keith Ellison’s face when Ellison came calling.

Ellison may have expected his deadline and lawsuit to put Abbott on the defensive, but Abbott masterfully turned the tables and put Minnesota’s own record on trial. If Ellison wanted a fight, he definitely found one.

Clearly Ellison gets himself way in over his head and intellectual capcity7 to forsee when he is about to make a fool out of himself. Now that Ellison’s ego has been bruised expect more BS for Ellison, it is his Playbook.
