A federal agent who spoke with Breitbart Texas on the condition of anonymity said, “U.S. Border Patrol agents were attempting to intercept a drug load. A law enforcement chopper was assisting Border Patrol agents. The chopper received gunfire from the Mexican side of the border. The chopper had to do an emergency landing due to the gunfire.”
Another source close to the matter told Breitbart Texas that “at least five shots were fired from Mexico and three hit the CBP chopper. The source claimed that two shots hit the cabin and one hit the engine. Another source close to the matter told Breitbart Texas that two shots hit the engine and one hit the cabin. Both sources cited in this paragraph claimed that an agent in the cabin was not wearing a vest and had it stashed on the floor and that the vest being on the floor ultimately saved the agent’s life. Agents explained that their vests are often placed below them in choppers because any rounds would come from below
And apparently they don’t give a damn about who’s life they have to take to get it
I just don’t get it. Police in our cities have tanks and all kinds of surplus military gear, but the border patrol doesn’t.

I would have to agree. The idea that they are shooting from one side of the border at a Federal Agencies Helicopter and the worst that will happen is a diplomatic protest which allows 1000 more undocumented workers in to the Country probably only emboldens them.

Actually, there is NO policy that says agents can’t return fire into Mexico.

It used to be an act of war to shoot from one country into another.
I wasn’t there so I can’t say. Lots of variables come into play during a shooting when you throw aircraft into the mix.
Given the current state of affairs in this country they didn’t shoot back to keep from being crucified by the media, their supervisors, the DOJ and this admin.
That’s a possibility.
But, depending upon the type of helicopter, the number of personnel on board, and the location of agents on the ground in relation to the scumbags who fired at the aircraft, they may not have had a chance to return fire.
Have they ever even exchanged fire? I mean we are talking about two countries here not across state lines. Also, since the belligerents firing upon CBP aren’t mexican militants, technically, its NOT an act of war correct? Would they be unlawful combatants?
Because the U.S./Mexico Border has been pretty much porous in nature since it’s creation in the late 1850’s, they are generally considered criminals. When you see the tactics the drug trafficking organizations use against each other and the government in Mexico, they ought to classify them as terrorists.
I can’t site any specific incidents of return fire into Mexico. Most of the shootings against patrol agents I know of occurred by perpetrators that were north of the border.
Regarding the act of war angle, if crypts or bloods or some other gang of criminals, operating in defiance of both national and international laws and zero affiliation with any official or even unofficial government ties, shot into mexico, would mexico have the right to declare war on us?
As I read it, criminals performed criminal acts and US officials, operating in uniform and ‘on the clock’ AKA government representatives, did not return fire to avoid even the possibility of unintentionally starting a war, even if it was in self defense.
Not trying to imply that I am happy with the ‘one hand behind their back’ situation, just explaining my (limited at best?) understanding of it.
Border Patrol Agents are authorized to return fire in self defense, regardless of international boundaries (both northern and southern). Rules of engagement still apply regarding means, opportunity, and intent of the attacker, as well as public safety considerations (firing into a populated area and so on.) The question that nobody here can answer is, did the agents have an opportunity to return fire? We don’t know the specifics of the incident (and probably never will).
If the aircraft in question is of the same type shown in the pictures throughout the news outlets, return fire from the aircraft would have been difficult, particularly if there was only the pilot and an observer on board.
