Trustees Living in Separate States?

I’m considering listing my brother and dad (happy early Father’s Day!) as trustees but since I foresee a military career in my near future–if I can get back down to MEPS again–I will probably be living in a different state than them. I saw someone post that you can “travel” with your SBR for up to one year on a Form 5320.20, but I’m sure I’ll be out of state for longer than a year at the time.

Possible scenario: I build SBR (X) for the trust. Also, my brother builds SBR (Y) for the same trust. I get stationed in state other than the one listed as our “manufacturing location” and take SBR (X) with me. I wouldn’t be able to move the location of just one SBR, would I? I assume the trust address would have to change, thus leaving one SBR out of state. But I don’t want to ASSume so I’m asking.

Sorry it’s a weird scenario, but it’s one that’s possible/likely for me.

Check with an NFA attorney or call Martinsburg. I would simply have them listed as Trustees, and then file a year-long 5320.20 for their domiciles. Renew the 5320.20 each year. If you move out of state, then you file a different 5320.20, but you also need to be up to speed on each state’s NFA ownership laws.

If they’re out of state, I’m not sure if or how adding their Title II firearm to an existing trust in your state would work.

Personally, I’d wait until you get settled a bit before going down the NFA route.
