Lawyers argued over how the court should respond to a note from the foreperson regarding the juror, who the lead defense lawyer said is the lone obstacle to a “not guilty” verdict.
The judge in the Lindsay Clancy murder trial declined on Friday to remove a juror who appears to be the lone voice against at least a partial acquittal of the nurse who strangled her three children in January 2023.
It said the holdout juror had acknowledged doubt about the case, but refused to follow the law.
Ms. Clancy’s lawyer indicated that the jury was split 11-1, according to the foreperson’s note, with the majority ready to find his client not guilty.
Both sides agree that she did it. But her attorneys argue that Clancy was suffering from postpartum psychosis at the time and that poor mental healthcare exacerbated her condition. Prosecutors argue that she intentionally planned the killings.
Before sending the deadlocked jury home Thursday, Judge William Sullivan declined a defense request to remove one of the jurors following heated discussions from both sides.
Earlier, the jury’s foreperson sent the judge a note saying a single juror won’t follow the court’s instructions about reasonable doubt.
Details of the jury room conflict weren’t revealed and only briefly discussed in open court, but it raised the possibility that a single holdout was standing in the way of a verdict.

Clancy, a 36-year-old former labor and delivery nurse, doesn’t deny strangling her children in the basement of their home in 2023. Her attorney argues that postpartum psychosis led to her actions, while prosecutors say she knew what she was doing
Reddington told reporters outside the courthouse that the foreperson’s note identified the holdout juror to the judge.
And he’s hoping that before the judge questions that juror on Friday, attorneys on both sides will get to argue over the specifics of that inquiry.
Reddington wants that debate out in the open, not in a private sidebar conversation.
