Dwayne Ferguson spent more than a decade advocating for nonviolence and peace in the streets of Buffalo.
He was a well-known face in the movement for the SAFE Act, the state law that made carrying a gun on school property a felony. He was also a familiar presence in the hallways of the city’s Harvey Austin Elementary School, where he worked in the after-school program and mentored students.
No one imagined that on Thursday he would show up at the school in possession of a gun, touching off an hours-long lockdown, search and ultimately his arrest on two felony charges.
Ferguson, 52, told WGRZ-TV that he frequently carries the gun, for which he has a permit, and did not realize he had it on him when he went to the school as part of the mentoring program.
Those who have worked with him also said they believe it was an honest mistake.
“I’m sure Dwayne went into the school not thinking he had the gun on him,” said Rev. James E. Giles, a friend of Ferguson and president of Back to Basics Outreach Ministries. “We know this for a fact, that he called out to a Buffalo police lieutenant asking why the school was in lockdown, and that they were looking for a man with a gun.

He was among local activists who stood with Assemblywoman Crystal Peoples-Stokes last year lobbying for a law that would make possessing a gun on school property a felony. Prior to New York State’s adoption of the SAFE Act last year, in response to the Sandy Hook school massacre in Connecticut, it was a long-established state law that guns could not be brought onto school property. The only difference was that the crime carried less punishment as a misdemeanor.
In an ironic turn of events, Ferguson was charged with two counts of criminal possession of a weapon under that law for Thursday’s incident. The law carries a maximum sentence of up to four years in state prison.

Well as Ferguson would have told any one of us had we made the same mistake…“Too ****ing bad…go to jail…why do you need a gun anyway…”
It’s usual par for the course of the ilk, one law for them, another for everyone else. That’s a given. He’s also the worst kind of gun owner, anti gun, but owns a gun, and should not be able to own a gun, because he’s unable to responsibly own it. Not in my 20+ years of CCW, day in day out, month in, month, out, year in year, have I have, one single time, not been fully aware of the firearm on my person, the status of it, and the responsibility of it. So, he either lied like the POS he is, or he actually “did not realize he had it on him when he went to the school.” Hence, he’s either a lying sack or irresponsible gun owner, or both.
Two, like all of that ilk, you can guarantee he will look for, and expect, special treatment regarding his “forgetting” he had the gun, in the face of the very law he pushed. Again, max sentences are for other people. Sadly, I bet he gets special treatment and does not do a day in jail for it.
We had a similar case in MA where a politician who voted for the 1 year mandatory year in jail for having an illegal gun, was found with an illegal gun, and didn’t do a day in jail. Per usual, mandatory only applies to other people.
Hence, why gun laws are by their nature and design and origin, elitist and racist.

I agree. Special treatment is likely. I keep thinking of the guy who got popped for bringing a TSA -stowed firearm through LaGuardia. Or the guy in in DC who’s in the jackpot because of an empty shotgun shell.

And who forgets they are carrying a gun? Other than the obvious here on ‘forgetting’ you have a gun on and how irresponsible that is. What use is a gun if you don’t know you have it.

Definitely in Manhattan. Upstate NY isn’t too bad from what I know of. NYC and the rest of the state are apples and oranges.
Depends on the county, lots politics played in certain counties and even being retired LE doesn’t guarantee you will get your license to even own a handgun, let alone carry one. NY is a lost cause, unless upstate can somehow break away from downstate I refuse to even to even go back home to visit.
