Interesting. I haven’t heard anything like this.
You’re asking us if we think it’s BS whether or not Felons would go through the trouble to register their SBRs & suppressors?
Really?
I think he’s asking if the requirement is BS or not.
Plausible, nothing official yet that I’m aware of.
this.
my responce to him was " what, are they going to ask for pics and cards for EVERYONE on the trust or llc?"
think about that, if you have your kids on the trusts so it will be come theirs if u die, and they arnt 18 yet, this will be a issue
I’ll know soon. I’m in the process of getting my trust written up and will start the process shortly. If it’s a new requirement I’ll post it.
My initial instinct tells me that the tin foil was wrapped too tight and it’s just a bunch of here say.
i dont think its now, i think he said it was coming down the road
No:
The requirements for fingerprints,
photographs, and the law enforcement certificate specified in § 479.85 are not applicable for
transferee who is not an individual.
but they are now requiring NICS checks for the individual taking possession of the NFA firearm on behalf of the trust/partnership/corp.
9.12.1 NFA Transfers to other than individuals.
Subsequent to the approval of an application requesting to transfer an NFA firearm to, or on behalf of, a partnership, company, association,
trust, estate, or corporation, the authorized person picking up the firearm on behalf of, a
partnership, company, association, trust, estate, or corporation from the FFL must complete the
Form 4473 with his/her personal information and undergo a NICS check. See also, question P6
This is all from the newly-revised ATF NFA Handbook.
My Revocable Living Trust is a 9 page legal document without fingers. How does one get it’s fingerprints?
It’s a special $500 process. ![]()
At least the pic shouldnt be a problem.![]()
THIS. Want to see how easy it would be to make this happen? Imagine this:
"9.12.XXX NFA Transfers to other than individuals.
Subsequent to the approval of an application requesting to transfer an NFA firearm to, or on behalf of, a partnership, company, association, trust, estate, or corporation, the authorized person picking up the firearm on behalf of, a partnership, company, association, trust, estate, or corporation from the FFL must complete the Form 4473 with his/her personal information and undergo a NICS check AND MUST ALSO SUBMIT EVIDENCE THAT COMPLETED FINGERPRINT CARDS HAVE BEEN SUBMITTED AND CLEARED BY THE NATIONAL FBI FINGERPRINT CENTER WITHIN THE LAST 90 DAYS. IN ADDITION, THE AUTHORIZED PERSON MUST SUBMIT A RECENT PHOTOGRAPH . See also, question P6
Yes - it would be that easy (bold part is simply my edit to what already exists). Far as I know, your Congress did not pass any law requireing a Form 4473 for a trust transfer; BATFE did that all on their own and NO ONE objected. The NRA does not give a crap about Title II firearms like supressors.
Think that its impossible for them to do this? Then riddle me this: who saw the 1986 MG ban coming before it was passed? (questionable as to whether it actually did pass, but it got signed into law anyway). Who saw into the future that they would class regular shotguns like the StreetSweeper as destructive devices?
Both those events came to pass. Never say never.
Same way they require “it” to pass a NICS check. They make YOU pass NICS. You got fingers (last time I checked).
(OT - call me, Robb! I wanna go shooting w/ you this summer @ T-mont. ). d
So would there be a reason to go the trust route if you get printed & photo’d anyways?
This has been floating around for 5+ years at least. Also includes Corp. purchases
too.
Bound to happen sooner or later, as well as CLEO signoff.
I guess you will figure it out or you won’t be buying anymore NFA items.
To avoid the local LE sign off.
So has anyone been told how this is going to work? Do you send the photo and prints along with your trust or do you send them separately to the FBI?
Is a NICS check required if you live in a state where a CCW can be used in lieu of the NICS check to purchase a firearm?
