I thought judges had the power to not allow a case to go to trial if there was no evidence or corroborating witnesses? Why did this even get to court?
Because, if the judge dismisses the case on a motion to strike, it is appealed. The court of appeals reviews whether the judge correctly selected the law, whether the facts were sufficient, whether a reasonable jurist could have come to a different conclusion, etc., etc. The case gets remanded to further hearing/retrial after the court of appeals highlights the judge’s mistakes in their appellate opinion.
If the judge lets it go to trial, the jury says “no.” Nothing to appeal.
Plus, if you are judge that has some legislative confirmation to undergo to be reappointed, do you really want to mess with legislators who know people who know people that could block your reappointment?
