Register SBR for 5.56, 7.62, 6.8. 300 BO

A friend showed me his SBR stamp and he registered it for all the above and it was approved. I wish I had done the same. Anyone else do this when registering SBR’s?

How do you add those to existing SBR’s stamps? I might get a 6.8 or 300 Black out in years to come.

I originally sent my Form 1 in with 5.56

When I asked my examiner (Nancy Flanigan) about how I add more lengths and calibers she just told me to send her an email with all the variations I might use and she would note it on the application.

Completely pointless.

You need to pay the tax to build the SBR, after that you can change to whatever caliber you want. The ATF asks you to notify them of any permanent changes so you don’t need to do anything if you want multiple uppers in different barrel lengths and calibers.

You do not need to ask permission to change the caliber or barrel length, you are not making a new SBR by changing the caliber.

Agreed. And at one point the ATF was apparently bouncing form 1s (at least some examiners) and making guys pick a caliber.

I think they were putting “multi” in the caliber and/or barrel length though.

Listen to Todd. He knows what he is talking about!

Let me think about that for a second- FUCKIN AWESOME! Thank you.

The gun is not “registered” in multiple calibers.

Your friend put the additional calibers in the other information box on the form which is not required to be filled out. It is meaningless information legally wise.

I know I am bringing up an old thread… That being said.

I have a complete DD factory MK18 sbr.
If I can possibly find one, I would like to purchase this DD 300 SBR Upper.
And sell the 5.56 sbr upper.

I think I understand what was being said, but to be anal about following law to a “T”… I am of the impression this would fall in a gray area of permanent change since I am selling the original upper.

I do believe scottryan, but there has to be a reason they ask for it on the paperwork. So I want to cover my rear. I think if anyone (LE particularly) were to have a reason to be an ass, it would at the most end up with my rifle confiscated.

SO… if I want to make myself feel better and to be 100% sure, I need to write the NFA of the change, correct?

I guess I would send the letter certified so I have record in the event they lose or misplace it?

Also, is there a creditable lawyer website that accurately summarizes ALL the NFA laws in laymens terms? The NFA site just seems to beat around the bush on many questions or be very vague I have regarding my sbr or it reads so that I loose my attention halfway through every sentence. I mean, geez, It took God only one stone to write down his law.

Yes, just write them a letter telling them of the permanent change of configuration and keep a copy of the letter. Wait a month and call them to make sure it arrived, they can give you a reference number for your letter.

Don’t expect a written response from BATFE NFA branch for 12-24 months. The one admin error on my Form 1 (which they approved anyway) took 15 months to get a reply out of them. The last time I notified them that I relocated my trust / NFA item for an in-state move was about 15 months ago and still no reply (yes, I know you can 5320.20 but I hate asking permission on those forms and rather like to notify them as the law states).

If you are worried about it send them a letter informing them of the permanent change. They won’t reply and sending it certified won’t get you anywhere.

It’s best to give them a month and then call and confirm receipt of the letter and make sure everything is in proper order. You can ask for a letter showing receipt of your letter but you will probably have to call back at least one more time to get it. My experience is that they do not like to send confirmation letters (but they will) although that could just be the examiners I was dealing with.

Do you think it would be safe to sell the original 5.56 upper before receiving a written response.

I do not even have the rifle yet. There was a problem with my trust and the NFA agent in charge of my application said it was a minor error where my name and trust name were both filled in and it only needed one or the other. She said it would take about a week for them to send it to my dealer, the dealer to correct it and send it back. That was about 1 month ago.

The underlying tone of all of the knowledgeable responses is ‘put whatever upper you want on your registered SBR, it matters not’.

Were it me, I’d sell what I wanted, buy what I wanted, and shoot what I wanted, and not send anything to the ATF that I wasn’t required to by law.

Yes, you can sell the upper whenever you want. Remember, you are notifying the NFA branch of a permanent change of configuration, not asking their permission. Same goes with in-state moves, notifcation. Only travel outside of your state (temp or permanent) requires permission, as well as selling an NFA item.

But if you listed all the caliber’s up front, then wouldn’t you have already ‘notified’ and not have to do it again?

My class 3 dealer told me exactly the same thing - register the lower with every caliber it could ever be used for…Then you’d already ‘notified’…

BATFE NFA branch might have changed things up… a couple of years ago they started kicking Form 1s like that back, with multiple calibers / lengths. Maybe they changed that.

Did Hussein ever put a new man in charge of ATF? I remember the news saying he was going to.

That could be a mess for all of us.
