I know this has been discussed more than once. Hillary can say whatever she wants and so can Obama. It doesn’t mean squat because it has to be approved by Congress.
Not only that, but the Constitution is the supreme law of the land. That means if this were to somehow pass it would be found null and void as it goes against the Bill of Rights.

Treaties have to be approved by 2/3rds of the Senate.
They also have to pass constitutional muster. You simply can’t pass a treaty to bypass the Constitution of the US.

I should have clarified- Senate. All too often I just say Congress. But, in any case you have basically spelled it out.
It is still dangerous, though. We are basically one vote in SCOTUS away from having the 2nd gutted. God forbid Obama gets to select another justice (replacing a conservative one). I have no faith that a liberal majority would uphold previous decisions or not got full bore on their “guns are for militias” dissent they gave out during Heller and McDonald.
I would have more faith over the long haul that the Senate would not have 2/3rds majority to flush away part of the BOR than SCOTUS.

Don’t forget that BO has bypassed Congress numerous times including sending troops to foreign countries and EVEN TODAY the announcement has been made that BO has yet again bypassed Congress to implement a new “economic plan” that will “help” those who aren’t qualifying for home loans to qualify! :rolleyes:
I wouldn’t put anything pass the current administration to TRY to do something about gun confiscation, but I don’t think they have the manpower to do it. There are a few scenarios that I can see going down with this type of power grab, but I think they know that they are biting off more than they can chew if they tried anything now or in the near future.

I have seen enough dramatic changes in my lifetime I know anythings possible. I don’t even want to get into how much things have changed from the time my Dad was in his early 20s or my Grandfather.

Won’t get any argument from me . Except for the one vote thing. I think it’s closer to 1.8 votes - which means that quality & depth of any case that goes to SCOTUS is a critical section of the puzzle.

The problem is if this idiot makes this an Executive Order (one of almost three hundred he has signed since he took office) does it become a lawful order? In other words, are the Federal agencies mandated to enforce such orders required to execute these orders?
We all agree that such action will fall under the “Illegal Order” heading as dictated by the US Constitution. But that doesn’t mean diddly to those who end up loosing their guns or their freedom because some agency and its agents decide to enforce the order.
IMHO, it is best to head this kind of stuff off before hillary, obama and their un buddies make any headway at all.
He cannot do it. Everyone acts as if the President has unlimited powers. Don’t you think it would have already happened if he had that kind of power? I mean seriously. And what exactly are we going to accomplish by kicking this around? You can’t vote Hillary from her position, you can’t impeach Obama for being an idiot. So why get worked up over nothing. I’ll tell you what. If it does happen, I would load up the battel wagon and personally drive to D.C myself.
Agreed…AND failed to uphold the Constitution while executing his duties as POTUS, AND has past laws which are in clear violation of the Constitution AND has appointed Czars to do his bidding who answer to no one…who plans his strategies to by-pass congress.
Yes on all accounts…its really strange (and scary) that people aren’t in an uproar over the things that he and the administration have done and continue to do (at a very rapid, spiraling out of control pace!). It is really unbelievable what he/they have gotten away with already.
