question about registered sbr lower

I know how the laws work for being required to have a stamp (and inscription on the receiver) for an sbr. What I’m curious about though is if you have a non sbr upper and put it on the registered lower do you still need to have the stamp with you all the time?

Ex. I have a 16" upper on my AR right now. I’d like to build an sbr 9mm upper for a range toy and I’d like to just use the lower I currently have. However, if I swapped the 16" upper back on would it still be an NFA item? Would there still be interstate travel restrictions?

No. If the upper has a barrel that is 16 inches or longer then its not a Title II weapon and not subject to the NFA while so configured.

First you need a registered lower or a pistol lower to own a short barrel upper. You cannot own a 9mm short barreled upper unless you have these two, and you would be taking a huge risk. Once your lower receiver is registered, the approved form1 should be with it at all times, the length of the upper doesn’t matter. I think you need to fill out paperwork and get it approved for you to carry your registered lower across state lines.

I think you’ll find this to be incorrect. If a registered lower has a non-SBR upper on it, it’s not an SBR.

That is not true. If it is in a title 1 configuration you do not need to have your paperwork with you, even when crossing state lines.

That’s not correct.
The second you slap a 16" barrel on a SBR it becomes a Title I firearm. Traveling betweens states (ones that allow ARs anyways) is a non issue and a Form 5320.20 isn’t required.

True to a certain extent. You would either need a pistol lower or no lower at all.

You do not need anything to own the upper. You need a registered lower or pistol lower to assemble/attach the upper of 16 inches or less creating the sbr/pistol.

Constructive intent. I would not recommend anyone possess all parts to make a sbr without having the registered lower.

Show me a case of constructive intent. The ATF does not go door to door checking peoples’ houses to make sure they are not owning parts to assemble a short barrel rifle. That is a damn myth.

Nor do they go door to door to see if you have it assembled.

I am not contradicting myself. You can buy the upper without any of the criteria you are saying you need. You cannot use the upper legal without the things you listed though(pistol lower/registered lower).
