I might have a move in my near future and am looking into NFA laws in Missouri. I am not sure I follow the comments in the listing I found. It states; (C&R mg, sr, sg only to non-FFL holders; FFL holders (including C&R) any mg, sr, sg). Do I understand that to own an SBR you need to be an FFL dealer?
I would try and contact the ATF branch in the area you are moving to.But to own a SBR ,I would think it is just the standard 200 tax and paperwork.I think it is the Form 4 but I am not sure.
Already own the rifle. Asking for clarification on the statement in parenthesis.
Missouri is not a SBR/SBS/FA friendly State. The only Class III weapons authorized in the State are Historical Weapons. Be carefull taking your SBR to MO. I would recomend call the BATF office in either KC or STL. Good luck.

In order to possess NFA weapons in Missouri one must hold a valid FFL. Most of us who aren’t in business satisfy this requirement with a C&R FFL. Everything else is the same as most other states. (The NFA items do not have to be C&R’s)
Suppressors become legal on August 28th of this year due to recently passed legislation.
The only gray area revolves around destructive devices as the law is somewhat vague concerning them. The law concerns ‘explosive weapons’ so grenade launchers are illegal but some DD shotguns have been successfully registered.

yakrat101 is correct. Get a C&R License and you are good to go for SBR’s, SBS’s, transferable MG’s and suppressors (in a few weeks…)

B. 1 copy sent to the Chief Law Enforcement Officer in your Area
I found no other requirement for the C&R license
- Submit Form1 with 2 Finger print Cards and Photo with Chief Law Enforcement Officer endorsement & $200.00
So I have submitted both C&R - Form 1 at the same time Should I be good to Go are should I anticipate some mishaps here?
And where is it on the Web stating the requirement for SBR ownership In Missouri?.

This is not true. In certain areas this can be true, but not state wide, at least not in my neck of the woods
A C&R is as easy as you state, just fill out the form, enclose payment and send it to the BATFE along with a copy to the local sheriff.
You will need a copy of your C&R license enclosed along with your form 1 before they approve it so you’ll have to wait for your approved C&R before sending in the form 1. Add your fingerprint cards, CLEO cert and citizenship cert and then sit back and wait for the mail.
And remember that you have to maintain an FFL of some type to satisfy the legal requirements so don’t forget to renew your C&R.

[b]Well I found my first Delay with my Form 1, I did not include Certificate of Compliance or FFL #- with my $200 , 2 finger print cards, form 1, CLEO endorsement, PP Photo.
I know my Form 1 has not been assigned I was thinking if I sent C of Compl. in it might join up with my Form 1 but I think thats wishful thinking.
But I’m also thinking since I may add additional uppers at diff Calibers to my sbr, I hear this info also needs to be submitted, I heard it could be done on an additional sheet?.
So i guess after my case is assigned and they notify me I can send FFL, Cert of Compl, Additions in at the same time I think that would seal the deal, What do you guys think? [/b]
I didn’t include my FFL # for my Form 1 and it didn’t stop anything - I don’t think the Feds care about your FFL status as that’s a state requirement. Your CLEO may not sign off on one without a C&R copy though. Your citizenship form will hold it up for sure.

Well After thinking about my Mistake I decided to send a duplicate package including , Cert of Compl, Copy of $200 Money Order Receipt, Form 1 with CLEFO endorsement w Pass Port Photo and delivery verification of the first package on 12-24-09 and who signed for it hopefully they will put the two together to complete the package I hope?, I hope this will not complicate things? I just hate waisting time when I know I can do something to fix a problem?

Yes I spoke w them yesterday and this morning I think theres a good chance my two packets might meet up since it had not been assigned to a investigator yet !
This certainly contains some helpful information for those of us in MO with interest in owning any NFA items. By going the C&R license route, I assume you just need to be sure you renew the license every several years? From my reading, it appears that the license is good for 3 years? Doesn’t sound too bad, just don’t forget.

On C & R’s I was wrong You can no longer download the Apps from Website, I got my app returned yesterday, what a disappointment, but they cashed my check and now I have to wait for Official Apps to be sent I spoke to someone at the Dist. Center to order my Apps , and the person I spoke with sounded so uninterested, I was very displeased but I also ordered online so I hope I get them in a timely manner?

From some reading here & else where if I’m understanding correctly Trusts are no good in Missouri ? and if you have the C&R FFL as Mo. Requires this is the only option Below?
6.2.4 Law enforcement certification. As provided by the regulations, the law enforcement
certification located on the back of Form 1 must be completed and signed by the local chief of police or
county sheriff, the head of the State police, the State or local district attorney or prosecutor, “or such
other person whose certificate may in a particular case be acceptable to the Director.”97 Examples of
certifying officials, other than those specifically mentioned in the regulations, who have been found to
be acceptable are State attorneys general, heads of district State police offices and certain State court
judges. Judges’ certifications have been accepted if the judges preside over courts of general
jurisdiction having original jurisdiction in all civil and criminal cases or the authority to conduct
criminal jury trials in felony cases. Generally, State magistrates and constables do not have such
authority. NOTE: no official’s certification will be accepted unless the official has jurisdiction over the
place where the applicant resides. The signature on each copy of the certification must be an original
signature in ink. NOTE: if the Form 1 being submitted is to reactivate a properly registered
unserviceable firearm, the law enforcement certification is not required. See Section 6.6.
6.2.4.1 What if the proposed maker is unable to find any official in his or her
jurisdiction willing to sign the law enforcement certification? The inability to find any
official to sign the certification will not excuse the requirement for the certification. In that
event, the proposed maker will not be able to obtain an approved Form 1 to lawfully make an
NFA firearm.
Is there a Trust option I heard you can have FFL. In corporation name that will allow trust?
A little hard to follow, but I think I know what you’re asking. The key here is that a trust is not the same as a corporation. There is no way I know of for a trust to hold an FFL, therefore there is no way for a trust to fulfill the state requirement of an FFL of some type.
Similarly, a corporate entity CAN hold an FFL, and a corporation can apply for and receive an NFA tax stamp. If you incorporate, you should be able to get a C&R licence through your corporation and then apply for an NFA item. This is how I understand the law but I make no guarantees. A simple call to the BATFE should tell you if a corporation can hold an FFL and if one can apply for/receive an NFA item. Corporations are less common because they usually cost more, require anual fees, have more impact on the rest of your life (taxes, records), etc.
So - corporation: yes. Trust: no. They’re not the same. I’m not a lawyer. My CLEO signs them.
