Out of State Firearm Sales Questions

This is not about shipping firearms out of state to an ffl.

Hypothetical. I’m in Florida shooting at the range (I’m an IL resident) and a fellow shooter, a Florida resident wants to buy my ar.
Is it legal to go to an ffl even though I’m not a resident of Florida and transfer that rifle to him at an ffl in Florida? What about a handgun?

I ask the same question about ammunition, would it have to be sold through an ffl?

I assume uppers by themselves don’t fall under any regulations and can be sold to anyone at any time so long as they’re absent from the lower?

I wouldn’t want to get caught up in some ridiculous statute I haven’t heard about or been able to turn up through internet research.

Guns have to e transferred in the buyers state, at least pistols for sure. Living in the boarder with another state it’s a common issue around here. No issues I’ve ever heard of with ammo. Uppers should be good to go but it’s kind of a grey area now with some states like Washington having bans on all AR parts. Now you don’t need a license/ID and there not serialized so most likely no one will ever know and it won’t be an issue if you buy in person…

To me, it seems like a private sale of an item, whether its a tennis racket, golf club, or Glock. If I’m at the range and wish to purchase a firearm from an out of state resident , I don’t really see an issue. Is there ?

I’m “guessing” Henri is accurate but since you have that FOID system in your "home state’, I have no clue what type of requirements that involves or if that follows you while on vacation.

I am not an FFL so I can’t give accurate information on the questions you’re asking, I’d recommend asking an FFL in the state you are visiting what the laws are.

As mentioned by other posters some states have crazy laws (like the FOID system).
With that said I would think its best to check local ffl’s (for laws of that area) instead of internet “opinions”.

WA does NOT ban AR parts, people just misinterpret the vaguely/poorly written law.

Some companies still sell here, because it’s perfectly legal to do so. Some do not, because they fear frivolous lawsuits by the spineless cuunt of an AG WA is stuck with.

But selling someone in WA an AR part is NOT illegal.

Yes. An FFL can receive a firearm from any unlicensed individual. They would pass it through their books and complete the transfer to the FL resident pending a NICS proceed.

Yes…Same as above. Sale would have to occur in buyer’s state of residence.

Generally no but there may be some dependence upon state law…CA for example.

Federal law prohibits an unlicensed individual from directly transferring a firearm to another individual who does not live in the same state. The transaction has to pass through an FFL. If it’s a handgun, the transaction has to pass through an FFL in the transferee’s state of residence. In all cases, the firearm has to be legal for the transferee to possess in their state of residence.

Thank you very much.

It’s pretty crazy. I recently went shopping for a 1911 and visited more than a few gun shops between Spokane and Pasco. Everyone is doing something different. A few are sellin no semi-autos. Some are selling 10/22’s, one is selling 10/22’s, PC9’s and Mini-14’s. Most have no AR stuff while you are correct some have stocks and guards to lower part kits. I haven’t seen any selling complete uppers though. It’s a mess.

A lady bought a shotgun here in CO when she was visiting as a FL resident. I guess there is a waiting period or some other restriction (age) that she wasn’t able to buy the shotgun in FL. There was noise made that the guns store shouldn’t be able to sell the gun to her because it violated FL law. I think the FFLs told them to pound sand.

Compliance with the laws of both states is required by 18 U.S.C. 922(b)(3), which I believe was a provision of GCA68.

So yeah, that shop ****ed up…

Probably the age thing. Florida is dumb when it comes to this. Unless you are LEO or Military you have to be 21 to even buy a long gun.

My biggest issue as an FFL is that I have a ton of visitors to Alaska that want to ship up a pistol for when they are visiting here and can’t believe they have to be a resident of Alaska for me to transfer it to them.

I can sell them long guns, but I actually require them to wait a day so I can research whether they can legally do so in their state. I have my list at work, but I know for a fact that I won’t deal with Massachusetts, New Jersey, Hawaii or Illinois long gun purchases unless they have their state cards.

You’re right, I can’t believe that.

Which law requires this?

GCA 68, an ffl can’t transfer a handgun to an out of state resident.

It’s why up until recently when UPS and FedEx decided to further assist the anti 2A element people could ship pistols to themselves at their arrival address.

Thank you for the info

You’re welcome! Be safe and have a great weekend.
