Obama and Holder decide not to prosecute USS Cole bomber

I am so angry. The US DoJ should be disbanded.

Well, you must understand the DoJ has limited resources, and cannot prosecute every evil-doer.

Right now the DoJ is focusing on Sheriff Joe Arpaio, so you see why a terrorist would be let go, because there are more important issues at hand.

What does this even mean? It doesn’t look like we’re letting him go. It also doesn’t look like he’s going to Federal court (though that may be the preferred method for the powers that be). I could be wrong, but it looks like they just threw the guy back into limbo while they spend another couple years debating what to do.

The way I read the article, perhaps wrongly, was that they aren’t going to try him in civilian court but are going to try him in a military tribunal, which is where it belonged all along.

Is it any surprise that the DOJ under Barack Hussein Obama (aka Barry Soetoro) would let an Islamic terrorists off the hook?

The DoJ is a very large organization, not all of which deserves to be thrown under the bus because of what the top leaders do to appease POTUS. The deal making that happens on the Beltway is far different than the field.

I am so disugusted with this administration…at a loss for words.

Many of the former military people who are now in federal law enforcement that I work with looked at the “collecting” of all of these foreigners in Cuba (Outside the jurisdiction of the United States) and wondered how any legal prosecution, either under the UCMJ or under U.S. criminal code would/could be accomplished. What laws would be applied and how? If they were tried under U.S. Criminal Code every single one of these guys has legitimate claimed about denial of due process. Not to mention that outside of a capital crime any crime we could charge them with has probably passed the statute of limitations, being held incommunicado without legal representation, never having been brought before a U.S. Magistrate is not going to toll that time.

This situation created quite the legal quandary without clear cut answers. They clearly cannot be prosecuted by DOJ as their due process rights have been violated six ways to Sunday. Introducing these guys into the criminal court system would result in a huge embarrassment to any administration once these people were subject to habeas corpus and explains why I think Bush 43 didn’t do a thing with them and preferred to hand the mess off. Holder isn’t going to try these guys because legally he can’t.

Military Tribunals under DOJ are probably the only way to go, outside of repatriating them to their own countries but we’ve seen what has happened to many of these guys after that has happened.

Grandpa had a saying, " no matter how hard you try, you can’t polish a turd". I think it it applies quite well to this situation; there is no way anyone or any administration is going to put a shine on this pile of shit.

Should have been allowed to execute them in the field anyway. From a legal and moral standpoint that bothers me less than secret prisons and such, and it worked for the Brits in Malaya.

The really sad thing about all this is that this type of news does not surprise me in the least. I have all the faith in the world that this moron… err… kenwaiian and his lap dawgs will come up with something even dumber, more counter-productive and anti-american than this over the next two-and-a-half years.

Prosecuting terrorists is often very tricky. Our system of righgs and legal protections that is designed to protect our rights struggles to deal with foreign terrorists. The legal issues surrounding terrorists captured on foreign soil based on secret information was the primary reason that the Clinton administration turned down Osama on a silver platter. Nobody knew what to do with him.

…well, the people in the administration didn’t know what to do with him. Shooting him in the back of the head and putting him in a shallow grave isn’t something they were capable of ordering.

I’d like to see the Guy fry…but a trial in our normal criminal justice system isnt likely to result in that. I don’t fault the administration on this one. I do, however, fault people like candidate Obama who have further complicated an already sticky situation for short term political advantage.

Best solution. Outside the borders of the US the Constitution does not apply to foreign nationals.

Once someone is in the possession of the US government or our agents, the courts may disagree. Even if the courts don’t touch it simply shooting people in the back of the head is certainly going to be a political issue.

Once one of two of our cities get nuked, I am sure the politics of the day will be a bit more tolerant toward hardline solutions.

I too am at a loss - agree that this administration continues to find new ways of baffling me. Honestly, they could drive Christ off the cross.
