I have a Draco that’s on a Form 1. I had an out of state gunsmith do the conversion to an underfolding SBR. I would have done it myself, but the headspace was short. He fixed the headspace, made the modifications for the underfolder, installed the buttstock, but accidentally messed up something else. I’ve contacted him and he said to send it back and he’ll fix it up. I decided to look and see if I need to notify the ATF that I’m sending it to him. So it basically reads that submitting a Form 5 isn’t necessary because a repair isn’t a transfer, but they recommend it so it doesn’t look like you’re transferring an NFA firearm, but you can just document what you’re doing instead, but they recommend you submit a Form 5.:rolleyes: Seriously, who writes an answer like that?
So my question is this. What do most of you do when sending in NFA firearms for repair, submit a Form 5 or not?
All you need to do is send it to him. Don’t worry about the Form 5. He will enter it into is record book as it is being repaired. That is typical BATF double speak.
