From MA no less. From a channel every gun owner should follow.
“An incredible new 2A decision applying the Bruen standard has set the stage for national reciprocity. An appeal of this case could get us closer to the declaration of nationwide reciprocity as a right which should be recognized just as fundamentally as the First Amendment, Second Amendment, and other rights laid out in the Bill of Rights. Armed Attorneys Richard Hayes and Edwin Walker discuss the new 2A decision and the precedent it could set.”
As a former Mass prisoner who escaped to New Hampshire, this is a nice ruling but unfortunately I don’t think the state will appeal it which means it only applies to this defendant. But it’s a good start.
Yea? I just worry that there will be some kind of national standard. Heck, they do it with the REAL ID sort of. The did it with drinking age and highway funds. Unless you end up with nation wide Constitutional carry, I’m not sure where this goes. I like the win, but I worry that judges could end up splitting the baby and this leading to screwing with our CCW rights in some states.
In an ideal world, States are just forced to recognize permits from all other States, like DLs. The requirements for DLs are different in each State. Some states you have unrestricted licenses at 16, some 17 some 18. It’s all over the place which is how ideally it would be with CCW. You would have to have a CCW permit from your home State even if it has Constitutional Carry and so on. But, nothing is ideal, so you may be right. It’s just annoying; okay, post Bruen we have Shall Issue pretty much everywhere even if they are throwing tantrums, but my NC permit is still not recognized in NJ, so I got an NJ CCW permit.
There is another 2A decision from 9th Circuit that could dovetail into that case and have more impact. It’s actually a knife case about Butterfly knives out of Hawaii.
The decision was that the knives are protected by 2A and not “dangerous and unusual”. The thought here now is that the pistol brace ordeal with NFA claiming they are “dangerous and unusual” will create millions more SBRs. Thereby making them not unusual. SBRs that is. It could lead to many things being removed from NFA.
At least things are headed in right direction. Virginian’s can finally carry concealed automatic knives as of July 2023.
Not a done deal with these cases by any means but a lot of things seem to be moving towards having our rights restored.
The fact that Caetano was decided in 2016 and stated that “the Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding” and has not been used over the last 7 years to strike down all these nutty laws is nuts. Now with Bruen’s “Text as informed by history” test all we need is money, brute force and a little bit of time and there is potential to erase all gun control. The problem is time.
States like New Jersey won’t even allow their own residents to carry a gun. But the federal government is going to force them via National Reciprocity to welcome with open arms this Tennessean to wander around the Garden State with a 17rd magazine loaded with “cop killer” bullets? uh hu…
