I predict that the property owner will be found not guilty as it is reasonable to detain a criminal who just committed a felony on your private property. Also if the property owner took reasonable action to disarm a person armed with a weapon (Hammer) inside his property but did not cause injury in doing so then no crimes have been committed.
The main word here is “Reasonable”, Is it reasonable to use the lease amount of force necessary such as placing someone in a confined area while you wait for the police to arrive during the commission of a felony? Yes!
Now it appears to be some bad blood between the property owner and the kids and being so did the property owner get a little too physical with the kids after the kids were under his control? Who knows but seeing the size some of these young kids grow these days and not knowing the physical condition of the property owner maybe the action the property owner took was appropriate.
So with just the minimum information as read in the news link there really needs to be some restraint with the opinions as once again we are guessing at the facts.

The sad part is it will take no telling how long for the criminal suits to play out. If the judges of the criminal cases don’t order the parents to pay restitution (not sure if that’s even possible) then the civil suits and most likely counter suits will probably begin. Hopefully the homeowner’s insurance company (assuming he had insurance) would cover it and go after the juveniles’ parents civilly. Then all they have to do is file bankruptcy.
Right here lies the issue, in my experience ATV riding adolescents are a crime wave, period! And I am not in the least bit surprised that their parents claim no responsibility for them…These ATV riding teens are a scourge, they destroy the land, run down game, set fires and vandalize private property, and then “poof,” are gone like the wind…
Any youth with unfettered access to an ATV, is a criminal, no exceptions…The parents should be the ones facing the jail time, and the parents should be forced to pay for full repairs to that property…
I won’t agree totally with you, as my kids are responsible off-road riders. They don’t have unfettered access, though, but they do spend a lot of time riding on public trails around here.
I will say that vandalism around here rise and falls, based on a few youths, in relation to whether or not their off-road vehicles are running or not. Funny enough, they suffer an inordinate amount of water in their gas and flat tires
What a bunch of fucktards!!! Those little shits knew damn well what they were doing, they did the time, they should do the crime, and if mom and dad stand in the way, they should be dealt with too. If me or my kids did something like that, I/they would have it a lot worse at home than what the law could dish out. Those asshat piss poor excuses for parents should be so ashamed of the way they raised those kids they should move way out of the neighborhood. I have NO RESPECT for those kind of parents!
He’d be charged with murder (or attempted murder) if he shot them. Very few municipalities in America will tolerate an adult killing adolescents unless there is compelling evidence that his life was at risk. The fact that they had a hammer would not have changed things unless he could show that it was being used as a weapon. This is especially true in NY where I believe that you have a duty to retreat before using lethal force in your home.
It seems that a number of people think that the mere presence of an intruder gives the homeowner free reign to kill. This can be a risky proposition in many states. Even in states without a duty to retreat, you never know if you might get a DA who happens to be a liberal Democrat that does not care what the law really says.

FWIW a friend of mine came home to find his next door neighbors kids roaming his house looking for valuables while the kids parents were outside directing them as to what to look for. Guess these kids were getting “home schooled”.
This whole thing reminds of the movie “Eden Lake”. Long story short a bunch of young kids terrorize a couple on a camping trip. The lady from the trip runs for help the entire movie and finally happens upon a house where a bunch of adults are having a party. Well she soon finds out the adults are the parents of the kids…does not end well for her.
The connection I am trying to make with the news story and the movie is that the parents in this real life situation appear just as nuts as the parents in the movie.
