Here is another example of where we are going wrong in this country. These kids should have had their asses beat and detailed to work at this home to fix the damage they did. Instead the guy that caught them is facing jail time, fines, lawyer fees, and court cost. This is B.S. What would you do if you came home and found kids destroying your home?
Jesse Daniels, 53, is accused of endangering the welfare of children for the actions he took after catching four boys in the act of vandalizing his father-in-law’s home over the weekend. With extensive damage done to the inside of the house, Daniels and his wife called 911 — and he went inside of the residence to confront the boys.
How is this considered “vandalism” when it is at best “breaking and entering / destruction of property” and at worst a “home invasion”? Furthermore they had a weapon “a hammer.”
Those parents are damn lucky somebody didn’t SHOOT their ARMED HOME INVADERS.
I think he could’ve detained the kids without locking them in the closet. I don’t think I can support that, at least not at the ages the kids were. He probably could’ve caught these kids on video so he has proof & identification.
Bigger question is what kind of nut case lives next door to his in-laws?

Are you serious?!?
Shoving them in the closet is the nicest thing I can think of. What kind of shit is just “get them on video”?!?
Those kids are lucky to be alive.
I understand the parents are giant fuckups, and have fuck up kids, and that is why they think the guy is at fault for catching their fuckup kids and being “mean” to them.
What would have been the outcome if a doberman had been there? The dog either would have fucked those kids up hard (much worse than being put in a closet) or they’d have had to kill the dog. See where this is going?
Also some people are taught to “hide and shoot” when dealing with home invaders. Imagine some old guy with a shotgun taking Uncle Joes good advice and putting two rounds downrange in the direction of the “bad guys.” See where this is going?
The parents of these kids, and anyone who thinks like them, need to realize this guy did them a HUGE FUCKING FAVOR. Their kids are alive. If my kid broke into somebodies home and started destroying shit and all that happened is he was treated roughly and confined to a closet until the police got their, I’d be GRATEFUL.
I’d send him a thank you card and an apology and I’d devote the rest of my anger and frustration to the individuals who caused the problem…MY KID and his fucktard friends.
My kid would also be reporting for duty for as long as it takes to get that house fixed to the condition it was in before he arrived. Any allowance money my kid would have would be allocated towards material costs of making repairs.
I’d also see if I could make some arrangements to pay the guy my percentage of restitution directly to him so that I could maybe just pay him and not administrative costs associated with the court. I’d hope the parents of the other four kids would do the same.
But that doesn’t seem to be how things work today. And that is why kids, even as young as 8-10 don’t think twice about breaking into homes and destroying things.
So shooting them is legal but locking them in a closet until authorities arrive is illegal?
Yeah, but you’re more hardcore than me. ![]()
Obviously I don’t know the layout of the guys home, but I know I could easily hold a couple of 8 yr olds in my kitchen. Even if one or two get away, you know “little Billy” is gonna narc on his friends. If not, that’s what the video is for. Also likely that a parent could ID the other kids.
I agree, worse things could’ve happened & the parents (& kids) are lucky but I guess I think of some of the stupid shit I did as a kid… Although I was smarter than that. ![]()
And for the record, I don’t think the guy should face jail time or fines, I just wouldn’t have done what he did.

The children’s motivation for the attack on the home isn’t known, however WHAM-TV reports that Daniels claims that the boys were riding ATVs earlier in the evening on Saturday and that his wife told them to get off of their property. The home attack may have been a retaliatory act, he contends
Right here lies the issue, in my experience ATV riding adolescents are a crime wave, period! And I am not in the least bit surprised that their parents claim no responsibility for them…These ATV riding teens are a scourge, they destroy the land, run down game, set fires and vandalize private property, and then “poof,” are gone like the wind…
Any youth with unfettered access to an ATV, is a criminal, no exceptions…The parents should be the ones facing the jail time, and the parents should be forced to pay for full repairs to that property…
I’m gonna venture a guess & say I’d bet that problem is local to you or sporadic at best. To say “Any youth with unfettered access to an ATV, is a criminal, no exceptions” is out there. I know many people, including myself, who grew up riding ATVs & dirtbikes that are good, responsible, law abiding people. In fact, I’d argue that it’s a good past time for kids, but I’m only a few hours south of you. Things are different around here.

Thats not even close to being a home invasion.
What are the kids actually being charged with?
ETA: I see that the kids have been charged…“Clyde Village Police took the children back to their parents and filed felony criminal charges of Burglary 2nd Degree and Criminal Mischief 2nd Degree”
Take legal action or take action yourself. Trying to combine the two is, especially when your action is of questionable legality is stupid.
Locking kids in a closet is a great way to be charged with kidnapping, doing so and then calling the police is stupid.
What these kids did is inexcusable, I blame their shitbag parents. I hope terrible things happen to them and especially their parents. I however would not risk my freedom to see it done.
This guy is facing jail time for not thinking before acting.
Did they know the home was unoccupied?
From here, knowing what we know, it sounds like a retaliatory attack for having the cops called on them and they broke into a house armed with a weapon.
Yep, that’s what I’d guess also. These kids & their parents need to be taught a hard lesson, here & now.

I must be really, really old. I can remember a time when confining a home invader that you were able to bring under control was pretty standard. This includes locking them in basements / closets and /or tying them up if not simply holding them at gunpoint.
I remember when some kids I knew broke into a guys garage to steal tools. He came out with a shotgun and told them “if you move I’ll shoot.” These were high school age kids and it was a non attached garage. The police came and arrested the two kids and nobody dreamed that the homeowner did anything wrong.
If you’d have asked them, I’m sure they’d have preferred to simply be locked in a closet.
Anyone who does shit like this at 8-10 is already done and heading no place good.
Is it Kidnapping? Or is it a citizens arrest? I’m curious to hear about the laws in New York about making a citizens arrest.
If I read it right, the homeowner told his wife to call the police and then locked the kids in the closet. Also, the police didn’t originally charge the guy with anything. It was only after the police felt pressure from the family, that charges were brought.
First thought: 40,000 dollars of damage. The parents would have to pay, so…the kids got grabbed by the throat and are traumatized from the experience…
I am thinking these are not the kids who wear helmets, knee, and elbow pads to ride a bike, or who cannot watch PG-13.So I assume they were not the least bit traumatized. And they really do not care, in fact, they may be lying about being grabbed and traumatized to get out of trouble.
I can see the parents saying, drop your charges,we will drop ours.
These kids are going to be the scourge of society, I agree there. I agree on all your points. My thing is not that what he did was “wrong” I am saying it was stupid. Especially when dealing with kids, they are not even teenagers.
Basically I am just cognizant of the fact it is 2013 and we live in Obama’s America.
I have no idea if it was kiddnapping, but being New York state and 2013 I sure wouldn’t be surprised, and I sure wouldn’t risk it, especially when you have already invited the police over.
In a perfect world this guy would have whipped the snot out of the little bastards, and the families would have seen to the property being fixed. However we live in Obama’s America which is disturbingly far from perfect and on a steep downward trajectory.
Can’t argue with that.
I just noticed that this was in NY.
I’ll like to change my answer.
He should have NEVER entered his own property because it would only provoke the children. He should have never confronted or attempted to confine them in any way.
He should have called 911 and waited outside for the authorities to arrive. He should probably be sentenced to “aggression counseling” for his actions.
Similarly the children should undergo psychiatric evaluation to find out why they get “angry” and should be medicated accordingly.
The parents should be investigated to determine how children were able to come into possession of an assault hammer.
Insane!
Will the parents of these young kids be paying to repair the damages?
…they better!

My sarcasometer is a little whacky today. I HOPE I’m reading this and correctly inferring this to be sarcasm. ![]()
