Kel-Tec CMR 30

I was looking at the Kel-Tec CMR 30 on their website and saw that the description shows that the overall length when collapsed is 22.7". If I recall a SBR is anything under 16" barrel and or the overall length (including the minimum barrel length of 16") is 26" at its shortest legal limit. Did Kel-Tec make and are about to sell an illegal SBR to the Public from the factory?

I believe that oal is measured with stock extended.
