Received both a call and e-mail from Ramos family members. They want the word out…call all your media contacts, radio talks show hosts, etc…… Ramos was beat up badly by a group of illegals after the “America’s Most Wanted” show aired Saturday. Grassfire.org has learned that imprisoned Border Patrol agent Ignacio “Nacho” Ramos has been assaulted in prison by as many as 5 other inmates – news confirmed by three family members.

The assault occurred at 10:00pm Saturday night (2/3), apparentely following the airing of America’s Most Wanted. According to Ramos’ uncle:

“Nacho was assaulted Saturday night around 2200 by about five illegal immigrants. He has multiple and severe injuries. They put him in Isolation for now, he has not been allowed to see a doctor since Saturday. They were yelling at him in Spanish, Maten a la migra. which means kill the Border Patrol Agent.”

Another family member said Nacho was attacked after he fell asleep Saturday night. Assaulters went after him with repeated blows and kicks. Ramos suffered wounds to his back, shoulder, arms and head. There is concern that Agent Ramos was not given medical treatment after the incident and may not have received medical attention for up to 48 hours. An investigation is expected to be launched Tuesday.

This is precisely the concern Mrs. Monica Ramos expressed in her FireSociety blog entry.

“Ignatio Ramos has been wrongly convicted and now put in harm’s way in a prison known to harbor illegal alien drug runners,” said Grassfire.org President Steve Elliott. “This is beyond an outrage. Our president must take action immediately to pardon these agents.”

In a phone call from prison, Ramos told his wife earlier today that he was assaulted in prison on Saturday night by a group of five Spanish inmates who Ramos took to be illegal immigrants. While beating Ramos, the assailants allegedly threatened him in Spanish, taunting him with, “**** la migra,” insulting him – “migra” roughly translating as “immigration,” slang for Border Patrol agent.

The assault occurred at Yazoo City Federal Correctional Complex, a medium facility federal prison in southern Mississippi, where Ramos had been moved about 10 days ago.

Ramos and Jose Alonso Compean began prison sentences last month, of 11 and 12 years respectively, for their actions in the shooting and wounding of a Mexican drug smuggler who was granted full immunity to testify against them. The case has caused national outrage, and dozens of congressmen are publicly insisting President Bush grant an immediate pardon of the two law enforcement officers.

Ramos’s family feels that the decision to place him in a medium security prison violates a promise from federal authorities Ramos would be kept in isolation at a minimal security prison.

At Yazoo, Ramos was housed with the general prison population. A medium security prison such as Yazoo would be expected to house illegal immigrants, including those incarcerated on drug offenses.

The prison attack came immediately after the airing Saturday night of a segment on Ramos and Compean by the “America’s Most Wanted” television show.

Patti Compean, wife of imprisoned agent Jose Compean, told WND her husband was in a different prison, still in solitary confinement.

Today is Ramos’ birthday. According to Loya, Ramos’s three sons, aged 7, 9 and 13, woke up crying, not wanting to go to school. The children wanted to buy a cake and wait for their father to call so they could sing “Happy Birthday” to him on the phone and blow out the candles.

Early this morning, Loya began working with the office of U.S. Rep. Dana Rohrabacher, R.-Calif., to see if the warden would give Ramos special permission to call home on his birthday, after his children got home from school.

Monica Ramos received the phone call from her husband in the afternoon, at 2:00 p.m. Mountain time in El Paso, while she was at work. She wondered why he was calling so early, not in the evening when the children would be home from school, Loya told WND.

“They are letting me call right now,” Ramos explained, according to his father-in-law. “I’ve been in isolation for two days now, ever since the attack, and they told me that I had to call right now. I got beat up real bad on Saturday night and I’m in real bad shape. They kicked me in the head, they kicked me all over the body. I’m all bruised and very sore.”

During the phone call, Ramos told his wife he hadn’t received any medical care in the 48 hours since the attack, Loya said.

Ramos told his wife he was able to identify only one of the five assailants: “They all cursed me in Spanish,” he said, according to Loya. “As they were beating me up and kicking me, they kept calling me ‘migra,’ ‘migra.’ I’m pretty sure they were all illegal immigrants.”

Ramos told his wife that he was badly bruised and bleeding from the ears. He said that immediately after the attack, he was placed back into solitary confinement, where he has been for the last two days.

I think I am missing something here. I am not familiar with why these agents are in prison to begin with, I don’t recall hearing anythign about them.

one of the b.p.a. shot a drug smuggler/dealer in the rear end , at the river, right after he assaulted the b.p. agent’s partner. p.o.s. escaped wounded across the river to be picked up by friends.

u.s. att’ office brought him back over to testify against the agent with full immunity. p.o.s. was a convicted felon and i beleive he was recently arrested again, for bringing drugs over the border. the 2 agents involved were recently sentenced to long prison terms (for doing their duty).

I must be missing something here because in the last paragraph the document states that Aldrete-Davila’s Forth Amendment rights had been violated. How can someone that is not a US Citizen have Constitutional rights?

There are two sides to every story

the prosecutors version is that the agents shot an unarmed man that was fleeing. They failed to report discharging their weapons and even altered the scene by picking up their brass. reportedly there was NO assault on the agents…one of them slipped and fell when he attempted to buttstroke the surrendering illegal

I wasn’t there, so I am not going to condemn their immediate actions…but when they tried to cover up the whole thing they dug a nice deep hole and a jury voted to fill it in

These guys and their attorneys have a great PR machine…one that tends to leave out a lot of details

MYTH VS. REALITY–THE FACTS OF WHY THE GOVERNMENT PROSECUTED AGENTS COMPEAN AND RAMOS

Myth: THE AGENTS WERE JUST DOING THEIR JOBS
Reality: Securing our nation’s borders can be a tough and dangerous job. Often, Border Patrol agents find themselves in difficult and dangerous situations. We give them guns and allow them to defend themselves. Border Patrol training allows for the use of deadly force when an agent reasonably fears imminent bodily injury or death. An agent is not permitted to shoot an unarmed suspect who is running away.

There was no credible evidence that the agents were in a life-threatening situation or that
Aldrete, the Mexican alien, had a weapon that would justify the use of deadly force. In fact, Border Patrol Agent Juarez, who was at the scene, testified at trial that he did not draw his pistol because he did not believe there was a threat. He also testified that Aldrete did not have a weapon and was almost to Mexico when Agent Compean began firing at him. In America, law enforcement officers do not get to shoot unarmed suspects who are running away, lie about it to their supervisors and file official reports that are false. That is a crime and prosecutors cannot look the other way.

Myth: THE GOVERNMENT LET A DRUG SMUGGLER GO FREE
Reality: My office would have much preferred to see Aldrete convicted and sent to prison for his crimes. We are in the business of putting guys like Aldrete behind bars. In fact, this office leads the nation in the number of drug smuggling cases we prosecute. Because the agents could not identify him, found no fingerprints, could not tie him to the van and did not apprehend him after shooting him, the case against Aldrete could not be proven.

Myth: THESE BORDER PATROL AGENTS SHOULD NOT HAVE BEEN PROSECUTED
Reality: The crimes committed by these agents rise to the level of felonies and are not mere administrative oversights. This was not a simple case of discharge of a firearm that was not reported. The truth of this case is that Agents Compean and Ramos shot 15 times at an unarmed man who was running away from them and who posed no threat.

This office cannot ignore these agents’ crimes just because the person they shot turned out to be a drug smuggler. Our system of justice requires that a person be tried in a court of law before he is punished. We do not permit police officers to summarily punish those whom the officers think have committed crimes. A police officer cannot shoot at an unarmed suspect who does not pose an immediate serious threat to the life of the officer or a bystander.

In order to maintain the rule of law, federal prosecutors cannot look the other way when law enforcement officers shoot unarmed suspects who are running away, then lie about it to their supervisors and file official reports that are false.

Myth: ALDRETE HAS BEEN ARRESTED FOR SMUGGLING MORE DRUGS INTO THE UNITED STATES
Reality: Aldrete has not been subsequently arrested for drug smuggling. Our office is in the business of prosecuting drug traffickers and alien smugglers. We are on the front lines of this battle and we aggressively prosecute these criminals every day in court. In fact, the Western District of Texas leads the nation in the number of individuals we prosecute for illegally smuggling drugs into this country. If we had a provable case against Aldrete, we would prosecute him.

Myth: THE GOVERNMENT GAVE ALDRETE BLANKET IMMUNITY FOR HIS CRIMES
Reality: Agent Compean failed to arrest Aldrete when he attempted to surrender; instead,
Compean tried to hit Aldrete with the butt of his shotgun, at which time Aldrete began to run towards the border. The agents shot at him 15 times, hitting him once, knocking Aldrete to the ground. Compean and Ramos chose not to walk over to the wounded Aldrete and arrest him; rather, they re-holstered their guns, turned around and left the scene. When Aldrete then got back to Mexico without having been apprehended and identified, there was no longer any way to tie him to the load of marijuana, except through his own admissions. Prosecutors promised Aldrete they would not use his truthful statements and testimony to prosecute him for the events that occurred on Feb. 17, 2005. Prosecutors around the country routinely make similar representations to obtain crucial testimony. This type of “use immunity” does not give blanket immunity for any crimes he may have committed or may commit in the future. If there were other admissible evidence besides his own statements sufficient to convict him, he could be prosecuted for the offense he describes.

As a practical matter, the promise to Aldrete gave up very little since the case against him was not prosecutable. There was no way to prosecute Aldrete while he was in Mexico. We could not have forced him to come back to the United States to be prosecuted, and there was no evidence against him until he agreed to cooperate.

Myth: ALDRETE HAD A GUN AND THE AGENTS ONLY FIRED IN SELF DEFENSE
Reality: Trial testimony from other Border Patrol agents who were at the scene and who arrived shortly after the shooting shows that this is not true. Testimony further revealed that Agents Compean and Ramos never took cover nor did they ever warn the other agents to take cover.

This action demonstrates that they did not perceive a threat. In his statement to investigators, Compean admitted that Aldrete had attempted to surrender with both hands open and in the air. Had Agents Compean and Ramos truly believed Aldrete was a threat, they would not have abandoned him after the shooting and they would have warned their fellow agents who arrived at the scene to stay out of the open while an armed suspect was on the loose. If the agents had believed that the shooting was justified then they would have left the crime scene undisturbed and let the investigation absolve them. The agents knew that Aldrete did not have a weapon and they knew he posed no threat to them as he fled. Agent Juarez also testified that Aldrete was surrendering to Compean with his hands open and empty palms turned to Compean.

Myth: THE AGENTS WERE NOT SURE OF WHAT THEY SAW BECAUSE IT WAS IN THE MIDDLE OF THE NIGHT
Reality: The events of Feb. 17, 2005, occurred at approximately 1:00 P.M MT.

Myth: JOHNNY SUTTON IS AN OVERZEALOUS PROSECUTOR WHO IS ON THE WRONG SIDE OF THE LAW
Reality: These agents were found guilty by a unanimous jury in a United States District Court after a trial that lasted more than two and a half weeks.

The two agents were represented by experienced and aggressive trial attorneys, both of whom vigorously challenged the Government’s evidence through cross examination.
Both agents told their stories from the witness stand and had full opportunities to explain their version of events and to offer their own evidence. The jury heard everything including the defendants’ claims of self defense. The problem for Agents Compean and Ramos is that the jury did not believe their stories because they were not true.

Myth: THESE AGENTS ARE FACING TOO MUCH TIME IN FEDERAL PRISON
Reality: Congress determined the penalties imposed on Compean and Ramos by setting the punishment for discharging a firearm during a crime of violence at a mandatory minimum of ten years (on top of any other sentence imposed). Congress did not make an exception for law enforcement officers

Myth: THE DRUG SMUGGLER WAS AWARDED A GREEN CARD
Reality: Aldrete was not given a green card which would enable him to have permanent legal resident status in this country. A military physician in the United States removed the bullet from Aldrete because it was an important piece of evidence and because the law requires the government to render such assistance. In order to have the bullet removed, meet with federal investigators and to testify in court in El Paso, he was entitled to come into the United States on a limited basis within a limited geographical area and only for those purposes. The last time he was legally allowed to enter the United States was in February 2006.

Myth: ALDRETE NEVER HAD HIS HANDS UP AND WAS NOT ATTEMPTING TO SURRENDER
Reality: In their sworn testimony, Agent Compean and Agent Juarez both testified that Aldrete did have his hands in the air in an effort to surrender.

Myth: COMPEAN WAS BLOODIED FROM A STRUGGLE WITH ALDRETE
Reality: Trial testimony showed that the only blood on Agent Compean was between his thumb and forefinger and was a result of him improperly holding his weapon. When asked if he was injured, he said “no” and when further asked if he wanted to file a report for his injury, he again said “no.”

Myth: THESE AGENTS DID NOT REPORT THE SHOOTING TO SUPERVISORS BECAUSE THE SUPERVISORS WERE ON THE SCENE OF THE SHOOTING
Reality: The trial testimony of the defendants, fellow Border Patrol agents who were on the scene and who arrived shortly thereafter, as well as taped radio communications showed that there were no supervisors at the scene at the time of the shooting. The agents knew they must report any discharge of a firearm and had just received training to this effect the day before this shooting. Further, Agent Ramos was a Border Patrol firearms instructor and a member of the evidence recovery team. He was well aware of this requirement as he had taught this to other agents. They did not report the discharge because they knew the shooting was not justified.

Furthermore, based on their training and experience, they were aware of what law enforcement resources would be dispatched to the crime scene to investigate a shooting, including sector evidence team, the Federal Bureau of Investigation, and state and local law enforcement.

Myth: ILLEGAL ALIENS DO NOT HAVE ANY CONSTITUTIONAL RIGHTS
Reality: The courts have held that the 4th Amendment to the Constitution protects all persons in the United States whether they are here legally or illegally. It is a violation of the 4th Amendment to shoot an unarmed person who poses no threat to the shooter. This law applies regardless of immigration status.

Myth: AGENT RAMOS CLAIMS THAT THE BULLET EXTRACTED FROM ALDRETE MIGHT NOT HAVE COME FROM HIS SERVICE REVOLVER
Reality: Agent Ramos stipulated and agreed before trial that the bullet extracted from Aldrete came from his service weapon. Independent forensic analysis also showed that the bullet extracted from Aldrete matched Agent Ramos’ weapon.

Myth: AGENT RAMOS WAS BORDER PATROL AGENT OF THE YEAR
Reality: Agent Ramos has never received any formal recognition or award for being the Border
Patrol Agent of the year. In fact, he has been arrested on at least two occasions for domestic
abuse and was formally disciplined for conduct unbecoming a federal officer.

Bottom line for me…they chose to go to trial…they got convicted

If the trial was not “fair” they should win their appeal

There are plenty of people that want to excuse their actions because the guy turned out to be an illegal and a drug smuggler…of course they didn’t know that until after they shot him…

Plenty of lawmakers are getting involved now…they can look tough on border security without really doing anything

It bothers me that the border patrol agent is allowed to be beaten in prison.
It bothers me that this thing went to trial.
It bothers me that Bush lies to me when he says his administration cares about our nations security but he has not done a thing to secure our borders. Cant care about one with out caring about another.

Obiwan’s posts are good for painting the other half of the story. I believe the truth is probably somewhere in the middle.

My brother-in-law recently retired from the Border Patrol as a GS-14 and is a friend with Ramos’ and Compean’s Supervisor. Accordingly, his opinion of Ramos and Compean is that they were “cowboys” always playing fast and loose with the policies and regulations and deserving of what they got. Ramos’ and Compean’s Supervisor is supposedly very distraught over all of this and on “suicide watch.” Not sure why, but I bet there were some things he was possibly aware of and/or failed to do, thus may have some “survivor’s guilt,” leaving them out to hang or upset that his career has ended.

My personal take on this is that both agents probably were very aggressive agents willing to push the envelope during the performance of their job, thus seen as renegades by their supervisor who probably had a very by the book, CYA mentality, and most likely a careerist. My take on the DA is that he is probably a very good DA, but one that is very aggressive and won’t let go of a case even if he knows the case is morally wrong because his ego won’t let him loose or appear weak.

Bottomline is that neither agent deserved the outcome they received and President Bush should step up and pardon them. Their careers in either Federal, State, or Local law enforcement are over but they shouldn’t have to spend 10 years behind bars and away from families to prove a point about being too aggressive in one’s duties. The signal it sends to those about the security of our borders is not the right one.

Recent DHS documents make it sound like their supervisor is in line for a reprimand at least since he allowed them to not report the shooting

I don’t disagree with anything anyone has said

But I will admit the “pardon” idea chafes a little

These guys got a trial…just like I would if I shot someone

12 jurors found them guilty

Their sentence stinks…but it is what I would get in federal court for commiting a felony with a gun

So a pardon…which basically means…you did it but we are going to forget about it…doesn’t strike me as appropriate

We learn far less from what happens when we do right, than when we do wrong. Learning from an error is a tough thing to deal with. These 2 guys are paying for their lies with time in the hoosecow!

The sentence is passed down from the Judge and I really hate to say this as well, would they have been in court, a criminal court, if they had done their duty and followed their use of force rules and not tried to cover up the situation? The answer is no, they would not.

Sentences should be tough for Officer’s who violate the law, like using their badge to make it possible to steal or to rape or murder… but a decade for lieing? for getting scared and lieing? If thats the truth Clinton should be just about ready to get out on good behaviour!

Let this be a lesson for everyone, just tell the truth. You always get in more trouble from lieing than from the problem at hand.

The prison officials need to toe the line and be held responsible for their failure to properly secure their charges. If they need to be, place them in protective custody, they f***ed up and tried to cover it up because of fear. Not willful murder. If we had a true secure border, this would be no more than a example for the criminals to learn from, Stay away from our damn borders. :mad: :mad: :mad: :mad:

Transfer them at least to a federal farm, together with white collar criminals… away from real scum…before they kill them, because they will if they get the chance!.

concur with you about lying. Although I am begining to wonder who lied to who. With Homeland Security recently admitting that their officials provided false statements to Congress about this case, I wonder if the Prosecutor provided false or misleading evidence to the jury to win a conviction. It wouldn’t be the first time that over zealous prosecutors have persued a weak case and fluffed up evidence because their ego demanded that they win.

I have no dog in the hunt on this case, but it is begining to stink and I think the smell will only get worse. Don’t be surprised if this case doesn’t get overturned on appeal, if not thrown out all together.

Washington-- A Department of Homeland Security report released today to the public contradicts original assertions made by the department about the actions of two Border Patrol agents convicted of shooting a Mexican drug smuggler.

Officials with the Inspector General s Office told ranking House members that Border Patrol agents Ignacio Nacho Ramos and Jose Alonso Compean were out to shoot Mexicans and that there was no threat to their lives.

The redacted Report of Investigation, written Nov. 20, more than a year after the original incident, failed to support the Inspector Generals Office allegations. The report also states that none of the other agents and supervisors on scene Feb. 17, 2005, the day of the incident, knew about the shooting.

A Department of Homeland Security memorandum, however, written by the original investigating officer Christopher Sanchez states that all nine Border Patrol agents on scene, including two supervisors, knew about the shooting the day of the altercation with the smuggler.

On Monday, Inspector General Richard Skinner admitted before the Homeland Security Appropriations Subcommittee hearing that four members of Congress from Texas were provided false information, regarding the agents, by his department at a private September meeting.

Today Rep. John Culberson, R-Texas, one of those four congressmen, demanded the resignation of all investigators and Office of Inspector General officials who supplied false information to Congress.

California Sen. Dianne Feinstein once again has called for a Senate hearing on the case. Last year, Feinstein urged Chairman Senator Arlen Specter, R-Pa., to conduct an investigation into the case. The committee began an investigation but it was never completed, Feinstein said in a press release today. Feinstein sent a letter to Senate Judiciary Committee Chairman Patrick Leahy, D-Vermont, urging him to investigate the case of the agents.

As time wears on, the people whom are not in jail are the ones that will be proven to be the ones who should be jail.

For the next couple days there have been wildly different reports floating around (all from Ramos family) and lawmakers have been demanding an update. Reports of bleeding from the ear and paralysis in one arm to name a couple

But here it is 2/9…almost a week later

And we got nuthin

So I poked around a little…and by digging a bit

Found that the prison reported minor cuts and bruises

They also reported that both agents were originally segregated but offered the ability to be put in general population

Only Ramos took it…he now claims he only did it because he thought he would be in a Low-security facility…not the medium security facility

Compean is apparently the brains of the pair

With all the focus there is on these two I am inclined to believe this report …there are plenty of people that would like to sensationalize this if they could
