A friend of mine has a Kahr 380 and at a local gun show a couple of months ago he picked up a “wallet holster” that makes it look like you are carrying a wallet but has a hole for the trigger and you can fire the weapon from the holster. He was showing it to me and a mutual friend who told him that holster makes the pistol a Class III weapon. Is that true? I have never heard of this before.

It’s an old letter, but the stupid rules seem to be the ones that hang around the longest. Ever visit www.dumblaws.com? It’ll scare you what stuff is still on the books, although not really enforced. I especially like these two from Wyoming, my state of residence.

There is no such animal as a ‘class III weapon’.
Non title 1 firearms are called Title 2 or NFA firearms.
A firearm that can be fired while still in the holster has been ruled by ATF to be a AOW (any other weapon) which is a Title 2 firearm and regulated by the NFA.
A pocket holster which the handgun can be fire while still attached is one example as is the briefcase is for the MP5K where it can be fired while carried.
For AOWs non-licensed manufacturers have to pay $200 to make an AOW (on a Form 1), and it transfers for $5.
Class III refers to an FFL dealer who can legally deal in NFA firearms.

A Serbu shorty 12 guage is an AOW - add a stock to it and its a SBS and must also be registered as such - add a stock and a long barrel, who cares - go figure.
