Bill to Repeal Ban on Short Barreled Rifles and Shotguns Passes Senate, Heads to Governor’s Desk for Consideration!

On Wednesday, April 14, the State Senate unanimously passed House Bill 2 by a vote of 31-0. HB2 now heads to the desk of Governor Bob Riley (R) for his consideration.

Sponsored by State Representative Jeremy Oden (R-11), HB2 would repeal the section of the Alabama statute that prohibits the possession, sale, receipt, or use of short barreled rifles and shotguns. These firearms are already legal under federal law when properly registered.

A special thank you to State Senator Lowell Barron (D-8) for shepherding the passage of this important piece of legislation during the final days of the legislative session.

So what happens if it is neither signed nor vetoed by the end of this legislative session? I’m familiar with the Federal level concept of a pocket veto, but I’m not familiar enough with the Alabama state constitution.

Did a little googling and found this:

If the Governor fails to return a bill to the house in which is originated within six days after it was presented to him (Sundays excepted), it becomes a law without his signature, unless the return was prevented by recess. In that case the bill must be returned within two days after the Legislature reassembles or it becomes a law without the Governor’s signature.

Bills that reach the Governor less than five days before the end of the session may be approved by him within ten days after adjournment. Bills not approved within that time do not become law. This is known as a “pocket veto”. It is the most conclusive form of veto, for the Legislature, having adjourned, has no chance to reconsider the vetoed measure.

So, by my calculations:

Date HB2 approved by Senate: 14 April 2010
Regular Session Adjourns: 26 April 2010
Date HB2 will become law without an Executive signature: 21 April 2010

So, no chance for a “Pocket Veto”. The only way this isn’t going through is if Riley vetoes it.

Just got off the phone with Gov. Riley’s office. He has a bill review scheduled for tomorrow (Tuesday) around 2 (according to the switchboard) during which time he’ll either sign of veto it."
