My lawyer called the ATF agent in N.O. La and he says that I have to become a FFL to get tax stamps. Is this right?

The stamps are issued by the federal government, and there has never been a FFL licensing requirement associated with the process that I am aware of – not even a simple C&R.
Unless they are citing some form of obscure state law that is only applicable to Louisiana (which should honestly have no jurisdicition over the federal approval process), I can’t imagine what they were talking about. If your state restricts NFA ownership, the BATFE simply won’t approve your transfer request.

Is your lawyer experienced in NFA trusts? From the OP it makes it sound like he’s not…I’d ask around and see if I find one that someone can recommend with experience in this area…
I sent him a link to a La lawyer that does gun trust, I’d like to use him because he is local, knows my family, and less expensive; just have to train him up.
OK 3 Form 1s and 3 Form 4s mailed out today. I’ll let y’all know how long it takes.

My Form 4’s for my cans are still not even pending, and the check was cashed a month and a half ago. And it was running around 6mo’s give or take a week or two from pending to approval prior to the panic buying.
Doesn’t matter, I’m going to be deployed to Saudi Arabia starting next week.
Just cleared a form 4 recently and it was pretty close to 6 months!:dirol:

This information can be found by anyone on the internet with a 30 minute search.
I did, but being in La you need a La lawyer as we are based on Napoleonic law, and the English law examples on the internet don’t apply down here.

Go with this…assuming you feel that the atty is competent.
Don’t try and get someone trained. You’ll probably end up spending more $$$ and get a questionable product. Get someone who is familiar with both NFA and LA trust law.
if you are set on establishing your trust under LA law then your wise going to an expert.

Re ATF, beware of what you ask for they may just do it. Chances are you will not like what you get.
Im not saying that we want to be ignorant of laws, to the contrary. But unfortunately, it has been my experience that most federal agencies get adventurous with such invitations/activities. I work with several federal agencies and there is only one (in one particular subset of their enforcement jurisdiction) that I like when they do such things and such instructions is always after significant input from stakeholders. Many may say “how can it get worse?” Trust me. It can. These type of presentations often end up creating more or as many questions and you are left with more uncertainty.
TX bar puts on an annual (at least it seems annual) CLE on gun laws and NFA is covered, albeit fairly briefly. You can view it online but it costs $. I also recently saw a VA bar meeting advertisement on a similar course but I didn’t pay much attention to the details but I know it was also recorded.
I went with this lawyer for $600, it was easy.
