From an objective standpoint, I think they poked the bear a bit too hard by selling a single kit that says “The Polymer80® Buy Build Shoot™ kit contains all the necessary components to build a complete PF940C™ or PF940v2™ pistol.”
Not that I’m for gov’t regulation, but hopefully they had war-gamed it out with their legal counsel and are on solid ground.

And seeing how this totally conservative majority Supreme Court is simply refusing to hear 2A cases (and cases that encompass issues that were conservative until ~10 years ago, but talking about will get one banned from this forum now), there isn’t even a snowball’s chance in hell that the court will interfere.
Devil’s advocate comment. If the unfinished receiver is not technically a firearm, what part of the 2A protects it?

There are also the 9th and 10th Amendments that cover everything under the sun which get ignored as well.
I’m no fan of a corrupt agency, but usually it is indeed the case where guys push crap too far.
I remember CavArms here in AZ as an example.
That the problem. If it is a firearm, there are laws that apply. If it’s not a firearm then it’s not subject to those laws. The idea of pushing these gray areas to the limit is clearly problematic. I’m not saying the company is wrong, it just doesn’t seem like thumbing your nose at the government is a business model that would have an semblance of longevity.
If you are within the law though, there should be no problem with thumbing your nose at the government.

I agree, so they shouldn’t be in the position they’re in. There in lies the problem. They either broke the law or they didn’t.
There in lies the problem in that it may not be so decisive. Are all the elements of the law present/clearly met? Is there precedent? Or are we operating in that murky gray area that requires judgement and interpretation?
“Why is the ATF involved?” Really? People making wall art? Christmas ornaments? Probably wouldn’t be hard to go on the “gram”/forums and collect enough content to show what the “common usage” is. Like bump stocks and pistol braces before 'em, people can’t STFU and leave well enough alone.
Don’t forget that the ATF is also a revenue collection agency and there are taxes / fees / etc that come with making a ‘firearm’ which are avoided if you only sell things as ‘parts’.
And besides, it costs ATF nothing to do this and take P80 to court. Maybe they’ll win, maybe P80 will settle, maybe they’ll lose. But they did the math and know that either way, it costs the individual agents / lawyers NOTHING to try it out.
Not seeing how their actions are any different than AR companies making no bayonet lug, no flash hider, and fixed stock rifles between 1994 and 2004 when it was obvious the powers that be didn’t like it.

Deep state is alive and well. Already ramping up, thinking the domestic enemy is going to move into the WH.
Several companies sell complete kits like these, have been for some time.
They hate us.

If you work for the PR department at ATF, maybe… Not so much that the lawsuit triggered it but hey we can be on the news “doing something” about this high profile issue. Certainly wouldn’t be the first time.
I love how there is a back room “determination” by the ATF followed immediately by a raid. At least Q got a cease and desist order rather than just getting their door kicked in.
