The State wasn't about to risk jury nullification in this case. Better to let the old man go free than look stupid by setting a precedent.
The article makes it seem like he was only a felon because of prior unlawful firearms convictions. I'd love to know the details on those convictions and whether they might be overturned as unconstitutional, post-Heller.
